The trial of real estate tycoon Sok Bun opened with a bombshell yesterday as it was revealed that former TV presenter Ek Socheata had dropped her complaint against the man who was seen viciously beating her on security camera footage that went viral in July.
Phnom Penh Municipal Court judge Sor Lina read a previously undisclosed letter from Socheata, better known to her fans as Ms Sasa, to the courtroom yesterday expressing the plaintiff’s desire to withdraw her complaint, without explanation. When contacted by thePost yesterday, Socheata refused to comment.
The family of the former CTN host has previously stated that they would accept no financial deal to drop the charges, including a highly publicised offer of $100,000 early on from Bun’s camp.
Bun was arrested 16 days after the July 2 incident, in which he was seen repeatedly punching and kicking Socheata in the head, and has been held at Prey Sar prison since.
One of Socheata’s lawyers, Puth Theavy, said he wished for the decision to be left “to the judge’s discretion”, while prosecutor Hing Bunthan requested that the court continue with the case regardless of any deals struck between the parties.
“We have seen that in this case, the accused Sok Bun really committed the crime of intentional violence with aggravated assault . . . I, the prosecutor, would like to continue with the charge and would like the court to prosecute the accused according to law,” he said.
Theavy said that Socheata told him in December that she wanted to withdraw her complaint because she had come to “excuse” Bun’s assault out of a newfound sense of sympathy for her attacker.
Similarly, Seng Sovina, one of Bun’s lawyers, said that both Socheata and Bun wished to bring the trial to an end. Sovina speculated that there might have been an extrajudicial deal reached, but he could not confirm that.
“I think there is a deal outside, but they’ve kept it private,” he said.
Sok Sam Oeun, a legal expert, said that according to Cambodian law, the case must proceed regardless of Socheata’s request.
Oeun speculated that Socheata might have opted for an extrajudicial deal to acquire more compensation money from the defendant. According to Article 218, Bun’s charge, the compensation amount is capped at 10 million riel ($25,000), along with a possible jail sentence of 2-5 years.
An undated statement read in court yesterday from Socheatas father, Uth Thy, a tycoon in his own right who had taken a leading role in the case, indicated that he had asked for $2 million in compensation in his initial complaint.
“I would like the court to prosecute [Sok Bun] according to law. I demand $2 million compensation for the treatment of my daughter,” it read.
However when contacted yesterday evening, Thy denied making that statement, instead saying that he had turned the case over to Socheata and that she and her lawyers had made the demand in his name.
While Thy said in July that he would reject compensation if it meant the tycoon would escape sentencing, yesterday he inferred that he had lost faith that Bun would face justice in the courts.
“Before, I decided to do whatever it took to bring Mr Bun to face the law. But if he faces the law, even if we don’t withdraw [from the trial], he would be released. This is what I know,” he said.
Neither Bun, Socheata nor the prosecution’s two witnesses were in court yesterday.
Theavy said that he did not know where Socheata was yesterday, but added that she had a right to privacy.
Bun’s lawyer, Sovina, told the Post that his client “was sick today” and had provided a doctor’s note to the court, but added that he did not know where Bun was receiving treatment.
Judge Lina said that she would announce a verdict on February 15.

US Secretary of State John Kerry yesterday pushed Prime Minister Hun Sen and Foreign Minister Hor Namhong on the need for greater political freedom in Cambodia during meetings in Phnom Penh but also praised the Kingdom’s “extraordinary” development since his first visit as a senator in the 1990s.
Kerry also met with opposition Cambodia National Rescue Party acting president Kem Sokha and civil society representatives during his brief visit yesterday, part of a swing through Southeast Asia ahead of high-level talks in China today.
Addressing the press at the Raffles Hotel after the meetings, Kerry described the talks with Hun Sen and Namhong as “candid and constructive”.
After emphasising the US was “deeply committed” to expanding trade and economic relations as well as anti-terrorism cooperation and continuing its development support, Kerry spoke about the “essential” need for political freedoms, his remarks contradicting a statement by spokesman for the Prime Minister Eang Sophalleth, who said human rights were not on yesterday’s agenda.
Kerry said it was “imperative” that even friends talk about what needs improvement, including “sensitive issues such as human rights”.


“In my discussions today, I emphasised the essential role that a vibrant democratic system plays in the development of a country and the legitimacy of its political system,” Kerry said.
“Democratic governments have a responsibility to ensure that all elected representatives are free [to carry out] their responsibilities without fear of attack or arrest; that is a fundamental responsibility of a democratic government, so as Cambodians prepare for elections next year and again in 2018 it is very important to allow for vigorous but peaceful debate.”
In recent months, two opposition lawmakers have been attacked by a pro-government mob, and CNRP president Sam Rainsy, stripped of his lawmaker status, has fled into self-imposed exile to avoid prison on seemingly politically motivated charges, while deputy Sokha wasremoved as the parliament’s first vice president.
Sokha said he discussed with Kerry his party’s desire for free, fair and non-violent elections.
“We raised the issue of the democratic process . . . and the election environment with regards to respecting rights and not using violence and the court system to pressure competitors.”
Kerry arrived in Cambodia from Laos and is laying the groundwork for next month’s US-ASEAN conference in California, which he briefed Hun Sen on yesterday, telling reporters US President Barack Obama looked forward to hosting ASEAN’s leaders.
Obama has assiduously courted ASEAN as part of a diplomatic “Asia pivot” aiming to offset China’s trade and diplomatic might in the region, with Cambodia viewed as a close ally of China.
Kerry also didn’t mention the controversial South China Sea dispute, though the briefing memo noted Cambodia’s chairmanship of ASEAN in 2012 left a “black mark” on the group, a pointed reference to the Kingdom’s unwillingness to risk the anger of major investor China by signing a joint statement on the contentious issue.
However, the dispute was discussed, according to Namhong and the prime minister’s spokesman, who said Hun Sen advocated for the signing of the long-stalled Code of Conduct for the South China Sea.
Namhong told a press conference earlier in the day that he had reiterated to Kerry Cambodia’s neutrality on the dispute. Namhong expressed “regret” over the fact that in 2012 they failed to issue a joint statement for the first time in ASEAN’s history, but also attempted to explain the government’s rationale.
“I had to keep the door open for negotiations, because if we said that this island belonged to this or that person, it would have caused a controversial problem that could have elevated to armed conflict,” Namhong said, claiming that Kerry “agreed” with his explanation and “did not say a word”.
A US Embassy spokesman declined to comment on what was discussed at the closed-door meeting.
According to Sophalleth, the premier also pushed Kerry to scrap taxes and quotas on all Cambodian exports to the US, called for increased trade and more cooperation on combating terrorism.
Ou Virak, the founder of political think tank the Future Forum, was among civil society representatives who briefly met with Kerry yesterday.
Saying the “substance was not as good as the photoshoot”, Virak said he got a few minutes to discuss environmental and social issues and emphasised Cambodians felt they had “nowhere to turn” given the perception of widespread judicial corruption and the government’s stifling of criticism online.
Political blogger Ou Ritthy, who also met Kerry, said the secretary of state encouraged civil society representatives to bring specific cases of environmental violations to his attention, via social media or the embassy.
Yesterday, roughly 80 protesters, including land dispute victims from Boeung Kak and Borei Keila, were prevented from reaching the US Embassy to highlight the government’s poor human rights record.
City Hall security guards blocked the group, saying they did not have permission to march, according to Boeung Kak activist Tep Vanny.

Kerry presses for reform in talks with PM

Prime Minister Hun Sen has defended the actions of two prominent tycoons accused of logging vast stretches of forest in Cambodia’s protected Virachey National Park as “legal,” according to a letter obtained by the Post.
Warning that Virachey’s forest would be “extinct in the very near future”, 23 opposition lawmakers sent a letter to the premier in July asking for an immediate halt to logging in the park by tycoons Try Pheap and An Marady.
Hun Sen’s reply came on November 16 and categorically absolved the pair of any wrongdoing.
“Both companies just collected forest products from the construction of a road in Virachey Park connecting Andong Meas district [in Ratanakkiri province] to the Dragon’s Tail area [between the Vietnam and Laos borders] and from timber seized from illegal loggers,” Hun Sen’s letter read.
“[They] followed the legal policy.”
The letter also praised the road’s construction, citing rangers’ difficulties accessing remote areas.
But Mao Monivann, one of the 23 opposition Cambodia National Rescue Party lawmakers, blasted the reply.
“In short, the government just explained this away to protect the people they are close to,” he said yesterday.
The case comes amidst an ongoing government crackdown on illegal logging on the eastern border.
Timber owned by Try Pheap in Stung Treng province has been inspected, although no further details of the inspections’ results have emerged.
Heang Sopheak, Tbong Khmum provincial prosecutor, said 259 cubic metres of timberowned by another tycoon, Lim Bunna, have so far found to be illegal, while 1,826 were legal.
Other officials said they were still tallying up timber.

PM defends logging tycoons

Prime Minister Hun Sen urged logistics companies transporting heavy goods to switch from container truck shipping to rail shipments, increasing cost efficiency while sparing the nation’s roads from load damage.
“We have a railway operating nowadays,” he said during a rice conference in Phnom Penh yesterday. “The problem is some cargoes are too heavy.”
“Heavy cargoes like steel, cement and other items that exceed 80 tonnes . . . will damage the road,” he continued.
“So we need to consider as a solution changing the mode of transport and working with logistics firms to gradually switch to using the railway between Phnom Penh and Sihanoukville for certain products.”
Cambodia has just one working railway line. The 266-kilometre “Southern Line” between the capital and the principal seaport in Sihanoukville opened to commercial rail traffic in 2013 after extensive rehabilitation. The 386-kilometre “Northern Line” linking Phnom Penh to Poipet and Thailand remains inoperative.
According to Sam Oeun Tith, commercial manager of Royal Railway, the company holding the 30-year concession to operate the country’s railways, freight trains run daily between Phnom Penh and Sihanoukville carrying oil, coal, building materials, garments and rice.
Tith welcomed the prime minister’s endorsement, insisting that using rail to transport bulk items was more cost efficient than shipping them by container truck. He said shipping a standard 20-foot container by rail from the capital to Sihanoukville costs about $100, and about $120 for a 40-foot container.
Trucks, by comparison, cover the same route for about $200 per container.
However, convincing logistics firms to switch from container trucking to rail shipments has proven difficult.
“We’ve tried for many years,” Tith said. “Many customers still use container trucks, but some have switched to the train.”
“We intend to expand services for heavy cargoes,” he added.
Ken Nhan, general sales and marketing manager of Chip Mong Group, welcomed the prime minister’s suggestion, but said the Southern Line had a number of shortcomings that were discouraging companies from utilising it for freight shipments.
One glaring issue, he explained, was that the line’s terminus in Sihanoukville was built just short of the seaport, requiring firms to unload their cargo from train cars onto hired trucks to transport it the last several hundred metres to container ships in the port.
“[The railway company] needs to extend the tracks to reach the port,” Nhan said.
“For now, the tracks do not reach the final destination and there is still a need to hire trucks to transfer goods from the station to the port.”
Nhan said railway performance was slowed considerably by the single-track line and limited service schedule. He said if the country’s railway service were fully developed his company would consider switching to it for transporting cement products, for which it currently relies entirely on container trucks.
Eng Sopheak, head of export and import at freight forwarder Meng Hong Leap Logistics Co, said while the basic cost of rail service was cheaper than container truck, the savings were lost once the time and expense of loading and unloading were factored in.
“Most of our clients choose to use trucks to transfer their products to Sihanoukville because it takes more time when using the train to unload goods at the station to transfer them to the port,” she said.
“The cost could end up being higher than going directly by truck.”
Chan Pech, general manager of Cambodian rice miller Signatures of Asia, said that although rail freight shipments might reduce transport costs, they could not match the convenience of container truck shipping.
“Trucks are faster and the time is flexible, while the train has only one fixed schedule departure per day – though it has the benefit of more capacity to carry more goods,” he said.
Pech urged Royal Railway to improve its services, build more stations and spur lines to connect rice mills and warehouses in the nation’s agricultural heartland.
“The timing must be faster and the schedule must have more point to point service,” he said.

Firms urged to take rail route


Several families yesterday burned tyres to protest the bulldozing of their land to make way for a road that will run next to a billion-dollar satellite city project on Phnom Penh’s Chroy Changvar peninsula.
Built by City Hall, the road will be set 100 metres west of National Road 6A. It will run alongside the Chroy Changva Satellite City, planned by tycoon Pung Khieu Se’s Overseas Cambodia Investment Corporation, which is embroiled in a land dispute with six communities living on the site.
As four bulldozers levelled plots they claim belong to them and security guards watched on, the families said they were offered inadequate compensation in exchange for about a third of their holdings.
“We are not against building the road, but the company and authorities should compensate us . . . in advance; don’t just come and clear our land like this,” said Uy Phary, who claimed she was offered $15 per square metre for land which she believed is worth $400 per square metre.
Her neighbour, Hul Savoeun, 45, said she had owned the property since 1993 and called the clearing of her crops and fence a “serious offence”.
Chroy Changvar District Governor Klang Huot said compensation would only go to residents whose houses are threatened by the road, calling those with who were only losing parts of their “huge land” narrow-minded and greedy.
OCIC spokesman Touch Samnang said that the firm was not involved in building the road.
